If you do not have a driver's license be it because of underage or you have chosen not to drive I urge you to take care and never be alone in a car where the keys are present. "Driving" without a license is a serious charge.

It forces a drunk to try to drive home from the bar instead of sleeping it off. Walking home can be dangerous in the dead of winter. People shouldn't get themselves in the position, but when they do the law shouldn't endanger the rest of us.

How far might they stretch "Physical Control"? If I am alone at my home with the keys in my pocket and the car in the driveway with a BAC of .08+ am I at risk for a DWI?

My buddy's dad got a DWI for the same thing, and he was sleeping in the backseat, not the driver's seat. This was in Wisconsin though, so who knows.

How can you be in "physical control" when you are sleeping? Sorry, your interpretation of the law is incorrect.

If someone has drank to much and gets to their car, they are now more likely to drive it home rather than attempt to sleep it off in their car.
