What do you think the fine print is for? Its for screwing over the average joe. Everybody puts a arbitration clause into their contracts because it allows them to circumvent the court system (where you have rights). Then they select an dispute resolution company that has incentive to judge in favor of the company, because they get their business from the company. Its always been scam and nice to see that someone with authority has finally been willing to do something about it.

There should be a law which gives you the right to decline arbitration. People can say that you should just not do business with a company that requires you sign an arbitration clause, but the problem is that pretty much everything has one included now days. So its almost impossible to avoid them. A company should not be able to require you to give up your right to a trial just to do business.

When a company requests arbitrion, no matter what, credit cards, satelite tv, rentals, I always select non-arbitration or write in that I DO NOT agree with Arbitration. I have never been denied service. Just an FYI...an arbitrator doesn't even need to have a degree or any experience in the field they are arbitrating, the company can assign a street bum if they want. My parents went through arbitration with a builder and lost...the arbitrator the builder used was from the texas board, the guy stayed at the builders house, the arbitrator was seen by my parents neighbors out drinking with the builder the night before and the builder gave him a ride to my parents house where the arbitration took place. Arbitrators are bought and sold.

add Construction Arbitration Services to the list as well. If you are in the market for a new home or remodel this may be the arbitration company the builder/contractor. The MN Assoc Realtors used it until a couple of years ago. I wonder why they dropped them and who they chose to replace them.

NEVER SIGN FOR ARBITRATION! http://www.trcc.state.tx.us/Arbitrators/default.asp Arbitrators The commission is able to certify persons who meet certain minimum requirements as residential construction arbitrators. Arbitrators certified by the commission are not contracted with or compensated by the commission, but may be contacted by anyone seeking arbitration services. The contractual terms of any agreements with a certified arbitrator are independently negotiated and not subject to review by the commission. In addition, arbitrators are not required to hold a commission certificate in order to arbitrate disputes involving a residential construction defect. Individually negotiated with the company in which you agreed to arbitrate with...who is the arbitrator going to side with, their boss??? Doesn't have to even belong to the board of arbitration...so essentually the company you are working with could have one of it's employee's handle the arbitration against you...and guess what you can't reverse it, it's legally binding and you agreed to when you agreed to arbitration.

I looked into credit card resolution. They wanted me to stop paying on my cards. They claimed approx 63% reduction in debt. I believe they forgot to mention that was after the companies racked up late fees around 100% of the balance.
