Gay marriage bans increasingly coming before appeals courts shaped by Obama's elections

WASHINGTON — The overturning of Virginia's gay marriage ban places the legal fight over same-sex unions increasingly in the hands of federal appeals courts shaped by President Barack Obama's two election victories.

The packing of the federal courts with left-leaning judicial activists is the "progressive" left's second front in their systematic dismantling of the Constitution.

Obama initiates the attack by issuing executive orders or simple decrees bypassing or changing laws he doesn't like (see Obamacare). In doing so, he knows that his flank will be protected if his actions are challenged in federal court.

The people of Virginia amended their Constitution to prohibit same-sex marriage. An Obama-appointed judge invents a non-existent "constitutional right" to gay marriage, and presto!: the Virginia Constitution is nullified.

Judges need to enforce that Americans, no matter where they live, receive equal protection under the law. Socially conservative states should have learned this lesson long ago when they prohibited interracial marriage. They must be slow learners as they are about to be taught another lesson.
