Family of brain-dead, pregnant Texas woman says hospital has removed life support

FORT WORTH, Texas — A brain-dead, pregnant Texas woman's body was removed from life support Sunday, as the hospital keeping her on machines against her family's wishes acceded to a judge's ruling that it was misapplying state law.

As I read the statute, quoted here, "Sec. 166.049. PREGNANT PATIENTS. A person may not withdraw or withhold life-sustaining treatment under this subchapter from a pregnant patient." ----- The words "may not" as opposed to "shall not," would to me, a person who is not an attorney, from a common sense reading is that the statute have very specific legal meaning, of permissive rather than mandatory regarding the withdrawal of life support measures. At least now Erick Munoz can now begin the healing process of losing his wife and her fetus. Acts 1989, 71st Leg., ch. 678, Sec. 1, eff. Sept. 1, 1989. Renumbered from Sec. 672.019 and amended by Acts 1999, 76th Leg., ch. 450, Sec. 1.03, eff. Sept. 1, 1999. .

Another example of how the term "Texas law" is a contradiction of terms and a paradox on its own. The same people who scream for less government and demand government stay out of their lives now take the opposite viewpoint and go against the married couple's wishes.

In the good old USA the poor little baby has no rights, even when the mother is dead. How gross is that. They will all meet there maker someday.

Oh, please, wisiag, you have NO idea what her dying wish would be. The husband who was her mate and had discussions about just this thing knows a hell of a lot more about what her dying wish might have been, if she had one. She certainly knew the situation about life sustaining measures or would not have had instructed him on what to do. We now also know that ultrasound evaluation of the fetus was showing that it was massively deformed, and had another couple months to go before it could possibly be born. You would condemn that poor fetus to a life of almost certain misery, even if born with a functioning brain? Your view is very difficult to fathom. Nature aborts about 1 in 5 fetuses before the woman even knows she is pregnant, which one might construe to be the kindest way to keep such things from happening and damning the fetus to just such a fate.

The religious right will spare no one of their crusades. No matter how much other people suffer they will forage on. They will protest the funerals of dead soldiers, they will force families to keep brain dead people alive.... they will force pain and suffering onto others because, because .... because they are moral and compassionate? No they are not either. They are extremists and harmful to others. Like the people that sailed here hundreds of years ago lets keep on trying to escape their insanity. Religious freedom also means freedom from religion.

I guess when they warned us that ACA would put the Federal government in charge of our healthcare decisions they didn't know the Texas state government had already beaten them to it.
