Ruling throws $10M wrench in suit over east downtown park

Activists suing the city of Minneapolis over a deal to build a park on the east edge of downtown received a major blow Friday afternoon when a Hennepin County judge ordered them to post a $10 million surety bond.

While sports aren't my thing and I doubt I will get to the new stadium to watch football at the exorbitant prices they want, the guys behind this suit sound like a bunch of small town spoil sports...the kind who parse words, laws, and anything else they feel superior about...a lot of jobs for working folks are waiting on this project, as well as revenue for downtown business...

"a lot of jobs for working folks are waiting on this project"---If we want to create jobs lets do it with things we all need fixed like bridges and roads and other necessary infrastructure. Spend the money on schools to make us more competitive in the global job market. Spend it on sewer system that needs billions. Lets put people to work for things that ALL the people need. We don't need to do work for billionaires for free when we have our own things to fix.

I agree with nkuhlman. This is a disturbing precedent. Courts have long required bonds to enforce an injunction or transfer property pending the outcome of a trial. But if the litigant could not post the bond the trial would continue without the preliminary ruling being enforced.

Here the defense argues that the mere allegation of illegal activity is sufficiently credible that they will be harmed; so the plantiffs should come up with $10 million before they are allowed to sue.

It's like this. MegaCorp bulldozes your house, kicks you off your land, and builds a shopping complex where your house used to stand. You sue and MegaCorp argues that the lawsuit alone could cause them so much harm that you should post a $10 million bond before you are allowed to have your day in court.

The same argument could be made of any lawsuit. Joe drives off the road and into someone's house. The homeowner sues for damages to their house. Joe argues that the litigation harms his ability to borrow money for his new business so the homeowner should post a bond for the potential harm Joe may incur. If the homeowner can't post the bond Joe doesn't have to pay for the damage he caused.

On a side note, it is ironic that the court's ruling depends on the case having merit and at the same time not having merit. The requirement for a bond depends on the theory that the lawsuit will fail yet the size of the bond is a measure of how much fear investors will have because the lawsuit may succeed.

The only thing that will change the minds of those insisting on the new stadium is when the law gets followed to the letter which means no bullying by anyone. Please write an article explaining exactly what the Minneapolis Charter states on the process of spending taxpayers money. Perhaps then all of this will be a clearer picture of what happened two years ago to create this mess now.

Some of you may want to re-read this article. This lawsuit filed has NOTHING to do with the Vikings stadium. This is lawsuit is part of the land near the stadium that revitalizes downtown Minneapolis. There are 2 seperate lawsuits going on. This one, and the bonds lawsuit for the Vikings stadium....both lawsuits that should be thrown out.
