US mom whose baby was taken away for days over poppy seed drug test settles lawsuit

PITTSBURGH — A woman who had her newborn taken away because she failed a hospital drug test after she ate a poppy seed bagel has settled a lawsuit over the case.

How about a hospital policy to not do any tests for non-medical reasons? And another to not make any non-medical decisions about test results. Talk about a major breach of trust. Too bad they weren't hit with a massive punitive fine at trial.

"The lawsuit alleged Mort was never told in the hospital that she had failed a drug test, nor was she asked if she had eaten anything that could have affected the test results." Of course not. To do so might have alerted her to flee with the infant. When it comes to drugs, infants or especially, as in this case, both, it's "guilty until proven innocent" and the element of surprise is paramount.

candcduluth: One can hardly blame "The Government" for protecting a child when a hospital reports that the mother may be taking opiates. The hospital went too far in not doing further checking before notifying.
