Elderly St. Peter woman’s two votes now a felony charge

A St. Peter woman with dementia who went to the polls for the primary forgot she also voted absentee.

This prosecutor should read the ABA Standards, Prosecution Function at some point in her career. Specifically, Standard 3-3.9 (Discretion in ChargingDecision), which says among other things: "The prosecutor is not obliged to present all charges which the evidence might support. The prosecutor may in some circumstances and for good cause consistent with the public interest decline to prosecute, notwithstanding that sufficient evidence may exist which would support a conviction. " it lists several examples.

It is hard to believe there was no way around charging this woman. She must be completely embarrassed by her mistake. At what point does common sense enter into the equation?

Makes a good story for talk radio - those poor folks have a LOT of time to fill. But this will amount to nothing, and it is hoped that someone is telling this woman so.

Nicollet County Attorney Michelle Zehnder Fischer should be ashamed of herself. Talk about a good-German mentality -- obeying orders no matter what. I don't believe for one minute that this could not have been resolved more appropriately. Nicollet County Attorney Michelle Zehnder Fischer is an embarrassment to the people of Minnesota. Watch this story fly around the world and make us all look like fools. Apparently Nicollet County has money to waste on needless prosecutions and should be giving the taxpayers tax cuts. Sad, sad, sad. Government harassing seniors with dementia. Shame on you Nicollet County and Ms. Fischer.

kiwara- you said it so nicely; I would have used only two letters to describe what the DA was shoveling. If they want someone to prosecute, it would be the election judge. Then plea bargain it down to never being allowed to be an election judge. Bill G.

We have so many real criminals we let walk everyday with a slap on the wrist. Read the johnny northside blog...same people constantly committing crimes and rarely getting punished, but we're going after an old lady with dementia? Our criminal justice system is unbelievably stupid. How about focusing your efforts on real criminals.

This was clearly an error by the election judge. Perhaps THAT person's competence to continue in an important position should be questioned. Elections are far too important to be overseen by an aging and sometimes forgetful group of people. It is time for younger people to start stepping up and doing their part to ensure election integrity.
