Unfortunately the guy is considered a hero in S. Africa. I see another O.J. trial coming.

Even if one were to accept his far-fetched excuse, it would still be considered a reckless and negligent disregard for human life by shooting through a door without knowing absolutely for sure who was in the closed bathroom since his life was in no way threatened. Thus, by definition, it would still be murder.
