"Barnes argued that the criminal charges should be dismissed in part because the state Department of Human Services has already taken steps to reclaim funds from her." A lawyer actually put forward this cockamamie argument? By that logic, if I rob a bank, I can't be tried for it if I return the money.

I've heard of some awful cases in which women faced impoverishment after the death of a husband; particularly if they had never worked themselves. I know of a few elderly women who in fact committed suicide in such circumstances. I wonder if Mrs. Barnes were facing such a dilemma. Does anyone have more information on this sort of thing?
