The NCAA correctly recognized that the PSU administration (up to and including the president) had swept this criminal activity under the rug for years in an attempt to PROTECT THEIR FOOTBALL CASH MACHINE. The NCAA also correctly recognized that having a sports program in charge of a school's integrity is NOT acceptable and therefore needs more than a slap on the wrist. Sure you can find a lawyer who will take on the NCAA (there's one under every rock) and finding a 'legal expert' to support the author's piling-on position is not at all surprising. But I hope the court supports the NCAA and PSU by agreeing with the sanctions that were imposed and AGREED TO BY THE SCHOOL. In hindsight, they probably should have shut the program down completely.

Penn State did not challenge the NCAA for a good reason. The fear that the Penn State athletic program would be handed the death penalty was very real.
