The only people who "know the market" are the 5 banks that ARE the market. Derivatives trading comprises the majority of market trades, and 96% of such trades are done by 5 banks--Goldman Sachs, JP Morgan, Citibank, Bank of America, and HSBC. So the question is: what constitutes insider trading when it is the insiders that do all the trades?
