This is nonsense. There is 10 times more litigation in the area od DUI than murder. jeesh.

OK, then MADD should provide one of these to each individual who does happy hour or goes out for the night......along with cab fare.

Sounds like reasonable doubt to me. When is okay to falsely convict, even in "rare and limited situations," using a measuring instrument that is "severely challenged" and "appears to be at the edge of its usefulness"?

Bottom line is to not drink and drive. I like to drink but I do it at home. Its just not worth the risk to hurt someone or yourself. And if that's not an option take a cab.

How about not driving when you drink - then you don't have to be concerned about the "rare and limited circumstances". I know - that doesn't deal with the machine error for those that are insane enough to drive. Consider it a calculated risk associated with the other calculated risks you are taking.

Agreed efrik1, When will they come out with testing and equal fines for distracted driving (cell phones, texting, screaming kids) as well as physically impaired driving, ie. senility, bilateral cateracts, uncontrolled diabetes, etc. all of which are 10 X more "impaired" than someone at a BAC of 0.08. MADD and others on this blog are hypocrites if the only look at one source of impaired driving...
